The significant feature of the youth justice system is supervision of the young people either within the community or within the detention facilities[1]. The UNCRC stipulates that young people should be detained and deprived of their liberty as a last resort[2]. However, in practice; children are confined to an isolation wing where they do not have any access to running water or sunlight. The cells are ghastly and seemed to be from the medieval era. Further, the wide publication of the CCTV footage and the images that revealed the abuse the children were being subject to routinely, while they are detained in the youth detention centers. The treatment that was provided to the detainees, who were 10 to 13 years of age, amounts to a breach of the human rights. In supporting this argument, I have learned about the issues that the young children are facing within the youth justice system from other media articles, TV Programs that have witnessed such abuse and violation of the human rights of the detainees. The Australian TV program, Four Corners, from the Australian Broadcasting Corporation presented a report on the barbaric treatment that the children in the Don Dale Detention Centre undergo while in detention. The images published along with the report defy belief but subjects the detainees to inhuman treatment. The Don Dale Detention Centre had six boys who were being held in the isolation wing. The counselor for these young offenders asserted that although there was sign of life in the detention centers but the lawyers had no knowledge who was in there and for how long the children were being held in such isolation wing. The Four Corner made revelation about the unexpected truth about the children behind the bars. The children are assaulted, stripped naked and tear-gassed. The children had nowhere to run and were death-scared. The treatment was inhuman, cruel and if any person would have treated their own children that way, the authorities would have taken the children from such person on grounds of cruelty. The images reveal that the youth justice system of Australia which was based on the concept that the children shall be deprived of liberty as a last resort, has become a system that punishes the young offenders instead of rehabilitating them by locking up 10 years old children and by keeping the 13 year olds in a solitary confinement[3]. In the report by the Four Corners, the juveniles were being detained in the isolator wings for 23 and half hours a day and most of the boys have lost all sense of time. The cells are extremely hot, no air-conditioning, no fans no light. If the boys ask for the reasons or the date or time, the officers use tear gas on them. They are often shackled, dragged and sprayed with a fire hose in the name of the applying reasonable force to prevent the juveniles from acting violently. I being a social worker would like to make some recommendations, which would assist the department in improving the conditions of the detention centers. The youth justice system must replace the punitive approach with other youth justice models that promotes therapeutic and rehabilitative approach. The Department of Youth Justice System, must make significant efforts to identify and respond to the issues faced by the victims and the trauma that the young people undergo within the youth justice system. Cultural considerations should be entrenched at all stages of youth justice proceedings. These recommendations would enable the Department to reinstate the concept that lays down the foundation of the Youth Justice System, that is, to rehabilitate the young children instead of subjecting them to inhuman treatment violating their human rights. For instance, owing to the dysfunctional nature of her family, Li’l Bit does not enjoy the support of her family members. The only person who appears to offer the girl the necessary support and attention is Uncle Peck. The uncle teaches the girls how to drive. Li’l Bit is however disappointed when Uncle Peck’s niceness ultimately proves to be tinged with selfish desires. For instance, the uncle molests Li’l Bit on several occasions. The mother thus betrays her daughter regarding the daughter’s dashed hope that the mother will come to the daughter’s aid (Vogel 25). Li’l Bit thus resembles Hamlet in that both come from somewhat dysfunctional families and are both betrayed by the people who should be their helpers. Moreover, both the Hamlet and the How I learned to Drive plays show that their respective protagonists are wise in their individual rights. Through such depictions of intelligence, the theme of betrayal continues to play out. For instance, Hamlet stages a drama performance that confirms that Claudius really murdered King Hamlet. This act demonstrates Hamlet’s extreme intelligence and also exposes Claudius’ act of betrayal. Likewise, Lil Bit demonstrates her wisdom by tactfully objecting to Uncle Peck’s indecent sexual advances. The girl does this and still manages to be friends with the uncle. Moreover, her firm refusal to engage in sexual liaisons with Uncle Peck discloses the uncle’s betrayal in seeking to have an incest-like relationship with his niece. In effect, Hamlet and Lil Bit are portrayed as intelligent characters as they seek to contend with the betrayal which they experience. Conversely, Lil Bit and Hamlet have several differences which serve to highlight the betrayal the two persons endure. For example, while Hamlet is of a royal class, Lil Bit has a humble background. The royalty in Hamlet’s family background partially make Claudius betray him. King Hamlet is murdered so as to pave way for Claudius to occupy the throne. On the other hand, Lil Bit’s humble background partially contributes to her betrayal by Uncle Peck. This is because most of Lil Bit’s family members are unreliable. The mother conceived during her teenage years, the father is sexist, while Uncle Peck the molester, is an alcoholic. This situation makes Lil Bit become alienated and thus continue to silently suffer under Uncle Peck. Her continued suffering thus unearths her uncle’s act of betrayal. Moreover, Hamlet finally revenges on Claudius heinous act while Lil Bit chooses to forgive Uncle Peck. The characters’ respective actions thus show that their relatives are betrayers who deserve either punishment of forgiveness. In conclusion, Vogel’s How I learned to Drive and Shakespeare’s Hamlet play explore the theme of someone being betrayed by someone they have always trusted. In How I learned to Drive, Lil Bit is betrayed by Uncle Peck, her mother, and her aunt, all whom she trusts. The second part of the essay will provide an argument of how applying these approaches from the upper management could potentially change the outcome of the industrial action against Lend Lease. Body: Pluralist approach: The characteristic of pluralist approach is to satisfy various interests and aspirations within their employees. The organization power was diffused among the main negotiating groups within the company in such a way that no any party will dominate others. Pluralism approach is open about employment relationships as it allows the creation of a potential structural opposition to be raised, as well as allows the workplace to generate certain conflicts with the organization. By doing so, it will prevent public interest conflict as well as to suppress the inappropriate use of power from the upper management. However, the weakness of pluralist approach is that it relies on the negotiation and bargaining process when there are disputes incurred between the management and the workforce, if in the event of the dispute cannot be resolved it will resorts to the use of law. Management in pluralist approach should not prohibit any ideas or expectations of blind obedience from the employees. Their goal is to reconcile conflicting views and keep the conflict within an acceptable range, so the conflict does not destroy the organization. The article mentioned that Lend Lease did not made a sincere approach to the negotiation and offered something that the Union consider as â€Å"a joke† which did not loosen the tension but added more stress on top of it. Based on the industrial action that has been taken against Lend Lease, it shows that Lend Lease was first using the Unitarist approach to their employees by not willing to negotiate with their new proposal. This has than created an enormous negative impact on both the social and the company as the projects were likely being delayed due to the industrial actions. Conclusion: In conclusion, Lend Lease would have been able to avoid the industrial actions by having a dynamic management approach on their worker base on different situation.
